This paper discusses the implications of legislation in regards to education of students with disabilities. The first point of discussion is the Individuals with Disabilities Education Act (IDEA). This act states that all students are eligible to receive a free and appropriate public education in which their individual needs are met. This means that schools must provide services, such as special education aides, if deemed necessary for a student's educational success. Additionally, IDEA also mandates that any discipline taken against a student with disabilities must be non-discriminatory and consistent with other disciplinary actions taken against students without disabilities.
The second piece of legislation discussed in this paper is Section 504 of the Rehabilitation Act, which prohibits discrimination on the basis of disability and requires providers to make reasonable efforts to accommodate persons with disabilities. This includes providing necessary accommodations, such as modifications to the physical environment and access to technology, so that a student can participate in their educational program on an equal basis with other students.
Finally, this paper also discusses how families of students with disabilities are affected by these laws. Under IDEA, parents must be consulted before any decisions are made about their child's education, including placement in special education programs. Additionally, parents have the right to dispute a decision made by school personnel through due process or mediation if they feel it is not in the best interest of their child. Meanwhile, Section 504 requires that schools provide information about services available to students with disabilities and provides for parental consent when needed for those services.
