Business law dictates how businesses operate, who their customers or suppliers are, what kind of contracts they use for transactions, and what forms of legal protection the business has. This includes areas such as contract formation and enforcement, taxation, corporate finance, intellectual property rights etc. In contrast, the Penal Code is primarily concerned with punishing people who have committed an offence against society’s norms. It also sets out a framework for dealing with these offences in terms of sentencing guidelines.
The relationship between business law and the Penal Code is complex. On one hand, business law dictates how businesses should operate and sets out certain rules for their conduct.
